The Employee Retirement Income Security Act of 1974, commonly known as ERISA, governs certain employee life, health and disability insurance plans.  The federal statute was enacted to protect employee interests by holding plan fiduciaries accountable, specifying information that must be provided to policyholders and requiring fair reviews of claims.  Quite paradoxically, ERISA insurance plans often use these complex regulations, which are supposed to ensure that they pay claims, to improperly deny coverage and ERISA claims for benefits.  Before employees can recover their ERISA benefits, they may be forced to navigate an ERISA administrative appeals process and bring suit in Federal Court.  By and large, well-funded insurance companies have a clear advantage over individuals.  Insurance companies have years of experience improperly construing policy language and denying claims based on unsupported medical opinions.  An experienced ERISA attorney can help identify problems in the insurer’s review, ensure your file contains sufficient records, point out problems with the denial and help navigate the ERISA appeals process.
